Criminal Charges With Real Consequences

Too often, people do not take assault and battery or domestic violence charges seriously. Depending on the specifics of your case, however, you can be charged with a misdemeanor or felony. A conviction for either charge can have long-term consequences on your employment opportunities, housing and your relationship with your family.

You can contest the charges against you with the help of an experienced defense lawyer, however. John E. DeVito Esq. of DeVito and Visconti, P.A. is a former prosecutor who understands assault and domestic violence cases from both sides of the courtroom. He knows how prosecutors are likely to proceed with each charge and how to counteract their strategy. Please call to schedule an appointment with a Dedham assault and battery defense attorney.

Arrested After a Bar Fight or Domestic Disagreement?

In Massachusetts, a misdemeanor assault and battery conviction has a maximum sentence of two and a half years and a fine of up to $1,000. The penalties are more severe for assault on a child, elderly person or police officer. Assault and battery with a dangerous weapon (aggravated battery) is a felony with a prison sentence of up to 10 years.

Domestic violence cases can be challenging for everyone involved. Police will likely arrest the person accused of domestic assault, even if the accuser retracts his or her statement. While there are certainly real cases of abuse, many domestic violence charges are the result of misunderstandings, bad tempers and alcohol. Attorney DeVito has the experience to know the difference between real abuse and a disagreement that got out of control on both sides.

Examining the evidence and interviewing witnesses are key parts of the defense. Mr. DeVito thoroughly reviews the prosecution's case, looking for weaknesses and improper police procedure. He gets to work immediately, before evidence and crime scenes are compromised and witnesses forget important details. When possible, he will argue to suppress evidence and reduce or dismiss charges.
